A House of Lords committee has issued a comprehensive recommendation for banning all gambling advertising across the UK, marking the most significant proposed crackdown on the industry's marketing practices in nearly two decades. The 17 September report from the Liaison Committee represents a hardline stance against gambling promotion, framing it as necessary to address what they describe as a growing public health crisis linked to betting activities.

The Scale of Gambling Harm in the UK

The committee's findings draw heavily on data from the Gambling Commission's Gambling Survey for Great Britain (GSGB), which estimates between one and 1.5 million adults now score high enough on the Problem Gambling Severity Index (PGSI) to indicate problem gambling. The PGSI system classifies scores of 8 or higher as problem gambling, with moderate risk falling between 3-7 and low-risk between 0-3. While some industry voices have questioned the GSGB methodology, the committee maintained these figures justify immediate regulatory intervention.

From Deregulation to Proposed Prohibition

The report identifies the Gambling Act 2005 as the turning point that unleashed today's advertising landscape. Prior to 2005, UK gambling ads were largely restricted to bingo, football pools and the National Lottery on broadcast media. Since deregulation, annual advertising expenditure by licensed operators has ballooned to between £1 billion and £2 billion, creating what the committee describes as an omnipresent marketing environment that normalizes gambling behavior.

The Case for Statutory Regulation

Committee Chair Lord Ponsonby of Shulbrede emphasized how digital marketing advancements since their 2020 inquiry have intensified risks: "The time was right to reassess this crucial policy area, focusing on the topic of gambling advertising where the former committee's strong recommendations have been largely unaddressed." The report condemns the current patchwork of ASA codes, co-regulation and voluntary measures as ineffective, proposing instead to place advertising oversight directly under the Gambling Commission with statutory enforcement powers.

High-Risk Marketing Tactics Under Fire

The committee singled out several practices for immediate prohibition. Direct marketing through emails, texts and push notifications faces particular scrutiny, with randomized studies showing opt-out groups reported significantly lower expenditure and harms. Dr Philip Newall of the University of Bristol highlighted an Australian study establishing causal links: "This group then self-reported significantly lower expenditure and harms [...] over the next two weeks." The report also demands bans on all inducements like free bets and sign-up bonuses, which it argues serve as predatory recruitment tools.

Sports Sponsorship and Youth Exposure

Despite voluntary measures like the Premier League's front-of-shirt sponsorship ban this season, the committee found gambling branding remains pervasive through sleeve logos, training kits and stadium ads. Dr Matt Gaskell MBE noted: "Overall exposure during live sports programmes does not show that self-regulation has reduced exposure meaningfully." The report reiterates 2020 recommendations to prohibit all sports-related gambling advertising, maintaining only limited exceptions for horseracing promotions.

Countering Industry Arguments

The committee systematically dismantled industry claims that advertising bans would drive players to unlicensed sites, citing European evidence: "Interviews with representatives of state monopoly operators across European jurisdictions consistently suggested that advertising restrictions did not lead to consumer migration towards illegal operators." This conclusion arrives alongside the UK government's 2023 gambling white paper reforms, including a new statutory levy for research and treatment funding.

Political Momentum for Change

The report aligns with growing cross-party consensus treating gambling advertising as a public health priority. A recent All-Party Parliamentary Group report similarly branded it as such, particularly emphasizing inadequate protections for children. While acknowledging DCMS research into digital advertising innovations, the Lords stressed this should not delay urgent policy implementation. Their recommendations represent the most comprehensive challenge yet to gambling's marketing freedoms in the UK, potentially reshaping the industry's relationship with consumers and sports sponsorships alike.
